West Palm Beach DUI with Injury or Property Damage Lawyer
Driving after consuming alcohol is not only an extremely risky and dangerous act, but it is also a violation of federal laws. Despite this, however, many drivers opt to take the wheel after having a few too many drinks. While not all drunk drivers are involved in damage-causing incidents, some do lose control of their vehicles and cause property damage or bodily injury to another individual.
If you have been involved in a DUI case that resulted in property damage or injury to another person, you will need a strong criminal defense lawyer to defend you in court. The West Palm Beach DUI with injury or property damage lawyers of Eric N. Klein & Associates, P.A. are experienced with these cases and qualified to help you with your situation. Please call our offices today at 561-353-2800 to schedule a consultation.
Florida DUI Law
The state of Florida classifies DUI incidents on different levels that are dependent on the severity of the situation. In general, the following laws are applied to drivers who are caught operating a vehicle under the influence of alcohol:
- First DUI conviction: a fine of $1000 or less and/or jail time of up to 9 months
- Second DUI conviction: a fine of $2000 or less and/or jail time of up to one year
- Third DUI conviction: a fine of $5000 or less and jail time of up to one year
- Fourth DUI conviction (and any subsequent offense of the same nature): a fine no less than $1000 and jail time of up to five years
Clearly, DUI offenses – repeat offenses, in particular – are not taken lightly by Florida law. If you have been charged with DUI, a West Palm Beach DUI lawyer of Eric N. Klein & Associates, P.A. can help defend you in court.
Florida DUI Misdemeanor and Felony Law
DUI offenders who cause property damage or bodily injury to another person are faced with a more stringent conviction and punishment. If someone driving under the influence causes any sort of property damage or minor personal injury to another person, they are charged with a DUI misdemeanor. The punishment associated with this conviction is up to one year in prison or up to $1000 in fines.
Drivers who cause serious bodily injury to another individual by operating a vehicle under the influence will be charged with a DUI felony. This act is a third degree felony and the offender is subject to a $5000 fine and/or 5 years of incarceration. Those who perform DUI manslaughter or vehicular manslaughter are charged with a second degree felony and will see fines of up to $10,000 and/or up to 15 years of imprisonment. Individuals who leave the scene after performing an act of DUI manslaughter or vehicular homicide are convicted with a first degree felony and will see penalties of up to $10,000 in fines and/or 30 years in prison.
