The First 10 Days
Unless your citation indicates otherwise, you may legally drive during the first 10 days following your arrest. After this point, you must file for review with the Florida Department of Motor Vehicles; if you do not, the suspension of your license is final. Once you file your review, you will be issued a license that will remain restricted until the Department of Motor Vehicles reaches a decision regarding your license.
The Hearing and Review
Approximately thirty days after your citation, the Florida Department of Motor Vehicles will hold a hearing regarding your license. The experienced driver’s license hearing lawyers at Eric N. Klein & Associates will vigorously defend you at this hearing. If the suspension of your license is found to be unlawful, your license will be returned and you will regain your driving privileges.
If, however, the suspension was ruled as lawful, depending on the results (or lack thereof) of a blood or breath test, your privilege to drive will be revoked for a certain period of time, usually between 30 and 90 days. After that time period, if you qualify, you will receive a “hardship license”, typically for five to nine months.
