Bond and Pre-Trial Release
After your arrest, the Court in most cases is required to set a monetary bond. If you cannot afford the bond and remain in jail, then the prosecutor must file formal charges against you within 30 days.
If no formal charges are made prior to the 33rd day then the Court must release you from custody on your own recognizance. The prosecutor can ask the Court for a brief extension of time based upon good cause, but no extension can be beyond 40 days from the date of arrest without formal charges being filed.
