Gambling Offenses
While some types of gambling have been legalized in Florida, there are still many laws that regulate gambling throughout the state. Gambling must be conducted in a way that conforms to the requirements and restrictions specified under the law. When an individual runs a gambling operation or participates in gambling through illegal avenues, he or she may be charged with a gambling offense under Florida law.
Participating in Gambling
Anyone who participates in a game of chance, such as cards or roulette, for money or other property is guilty of gambling under Florida law. There are exceptions for those who gamble in Bingo games run by charitable, nonprofit, or veterans’ organizations, which are allowed under Florida law. Anyone found to be gambling outside of the legal limitations, however, is guilty of a second degree misdemeanor.
Allowing Gambling on a Pool Table
Anyone who owns a pool table and allows a person to play and gamble on a game may be charged with a criminal offense. The owner may not allow any person to bet money or anything of value on the outcome of the game as either a contestant or spectator. Violation of this law is a second degree misdemeanor.
Keeping a Gambling House
In the state of Florida, it is illegal for a person to own or run a gambling house or to have any gaming equipment that is used for gambling. Gambling includes betting money or any valuable thing on the outcome of any game. Any person found to be guilty of running a gambling house or gaming equipment may be charged with a third degree felony.
Clearly there are several strict laws that regulate gambling in Florida. If you are unaware of the law, you may find yourself participating in practices that you did not know were illegal. It is therefore important to know and understand the laws regarding gambling practices before participating in gambling activity in the state. If you have been charged with a gambling offense, it may be in your best interest to consult with a criminal defense lawyer as soon as possible to ensure that your legal rights are protected.
