DUI Booking and Bail
Booking and bail is a necessary part of nearly all DUI arrests. Once you are arrested, you will be taken to the police station to complete the booking process. While you are in custody of the police, it is important to remember your rights and remain calm. If you become excessively emotional or upset while you are at the police station, you may behave in such a way or say things that could later be used against you in court. Knowing the booking and bail procedure ahead of time can help you stay calm and know what to expect when you are arrested.
When you are taken to the police station, you will be subjected to a search and will be questioned. It may be in your best interest to keep your answers short and limit the amount of information you provide. The police may videotape the questioning process, and you and your lawyer may request a copy of the tape. It is highly recommended that you do so because the tape may be used as evidence in court. During the booking process you will also be fingerprinted and photographed.
Once the booking process is complete, you will be placed in a jail cell. In extreme DUI cases, bail may not be set and you may have to remain in jail for an extended period of time. In most cases however, a bail amount will be set. At this point you will be allowed to contact a bonding company directly or call a family member or friend to post bail. The posted bail money will be returned after a court decision has been reached for your case, unless you do not show up to your court hearing. In Florida, you will be required to remain in jail until your blood alcohol content (BAC) is under .05.
