Classifying Offenses

Crimes are classified based on their seriousness. The value of the damage to the property and the degree of injuries sustained by the victim are used to determine how serious the crime is. In addition, factors about the defendant will also matter when filing charges. If the offender has a previous criminal record or the crime was found to have been committed with cruelty and malice, the crime will be considered more serious.

On the other hand, if the defender is an outstanding citizen who has a long record of good deeds but violated the law, the judicial system may prove more lenient. By looking at all these factors, a less serious offense may be made more serious or a more serious offense may be made less serious.

Historically, there have been three categories of criminal offenses: felony, misdemeanor, and treason. Treason used to be considered the most serious crime under English law. In the colonies, treason was distinguished as a separate charge, and only felony and misdemeanor were used to classify criminal offenses.

Today, United State retains the categories of felony and misdemeanor. However, there is now an additional tier meant for offenses that are less than misdemeanor. These offenses in this third tier are known as infractions or petty offenses.
